Special Distribution Benefits Created

Special Distribution Benefits are benefits that were created by the Courts on three occasions following their determination that the Trust Fund was financially sufficient and there were more settlement funds available than were needed to pay the ongoing entitlements under the 1986-1990 Settlement.

The Special Distribution Benefits created by the Courts in 2017, 2018 and 2023 that are available to class members under the Transfused HCV Plan and the Hemophiliac HCV Plan can be viewed here.

Because the HCV Late Claims Benefit Plan was one of the first Special Distribution Benefits that was created, the amounts for the other Special Distribution Benefits that were created in 2017 are combined with the benefit amounts payable under that Plan. The Special Distribution Benefits that were created by the Courts in 2018 and 2023 that are available to late claim class members under the HCV Late Claims Benefit Plan can be viewed here.

It is important to note, that class members are paid the same amount for both the original benefit and the 2017 Special Distribution Benefit regardless of which Plan they are being paid under.

For those under the Transfused HCV Plan or the Hemophiliac HCV Plan who had already been paid their original benefits, 2017 Special Distribution Benefits were issued as a separate payment starting in 2018.

For those under the HCV Late Claims Benefit Plan, the benefit amounts and the 2017 Special Distribution Benefits were combined and paid as a single payment.

It is also important to note, that the amounts payable for benefits under each of the Plans and for Special Distribution Benefits are all indexed using the Canada Pension Index to the year in which they are actually paid to the class member.

The Administrator has automatically issued retroactive payments for these Special Distribution Benefits where it could do so and the vast majority of those payments have been made. However, payments could not be made where the Administrator did not have current contact information for the recipient or, in some cases, the name and contact information for an executor of the estate. If you or someone in your family has not received an expected Special Distribution Benefit payment, please contact the Administrator to determine your entitlement and to ensure it has accurate contact information for you. Efforts will continue to locate all entitled recipients.
