The 1986-1990 Settlement
1986-1990 Settlement benefits became available under the Transfused HCV Plan and the Hemophiliac HCV Plan once administration began in 2000 for those persons infected with HCV or their estates who meet the Claims deadlines under the Plans and whose Claims are approved by the Administrator. Family members and dependants of HCV infected persons may also be entitled to make a Claim for benefits following the HCV infected person's death, if HCV materially contributed to that death.
1986-1990 Settlement benefits also became available under the HCV Late Claims Benefit Plan (Late Claims Plan) created by the Courts in 2018 for HCV infected persons, estates, family members and dependants who missed the claims deadline that applied to most Claims under the original Plans.
While the deadline to bring an initial Claim under the original Plans and the deadline to seek leave to make a Late Claim under the Late Claims Plan have passed, there are some limited circumstances in which a Claim or Late Claim may still be brought despite the expiry of these deadlines.
Administration of the Plans continues to process those remaining Claims and Late Claims that are still able to be brought under the Plans and to process ongoing benefits that are payable in respect of Claims and Late Claims that have been approved by the Administrator.
More than 15,000+ approved Claims and Late Claims have been paid in excess of $1.39 billion under the 1986-1990 Settlement to date.
