Claims after the Transfused HCV Plan and Hemophiliac HCV Plan First Claim Deadline
The Transfused HCV Plan and the Hemophiliac HCV Plan provide that the following Claims may still be brought, despite the passing of the June 30, 2010 first claim deadline, provided they are made within the timeframes indicated:
- HCV infected persons who have been diagnosed with HCV within the last 3-year period (including spouses or children secondarily infected with HCV by their HCV infected spouse or parent making a claim for their own secondary HCV infection) making a Claim within that 3-year period;
- Persons who have reached their age of majority within the last year (including primarily and secondarily HCV infected persons and also certain family members and dependants where the HCV infected person has died and HCV materially contributed to that death) making a Claim within that 1-year period;
- Spouses or children secondarily infected with HCV by their HCV infected spouse or parent claiming for their own secondary HCV infection making a Claim within 3-years of when their HCV infected spouse or parent first made their Claim;
- the estate of an HCV infected person making a Claim within 3-years of the HCV infected person's date of death; and
- certain family members and dependants of HCV infected persons making a Claim within 3-years of the HCV infected person's date of death, in those cases where HCV materially contributed to that death.
