HCV LATE CLAIMS BENEFIT PLAN HOLDBACK REMOVED

The HCV Late Claims Benefit Plan (Plan) was launched in 2018 to permit persons infected with the Hepatitis C virus from blood or blood products received between January 1, 1986 to July 1, 1990 who did not make a claim prior to the June 30, 2010 deadline under the original Transfused HCV Plan/Hemophiliac HCV Plan to apply to receive benefits under the new Plan.

The type and amount of benefits provided under the new Plan combines the benefits available under the original Transfused HCV Plan/Hemophiliac HCV Plan and the HCV Special Distribution Benefits more recently ordered by the Courts.

To ensure that there were sufficient funds in the new Plan to meet the claims experience, the Plan initially required that 25% of the compensation payable to approved claimants be held back until such time as the Courts determined the holdback could be modified or eliminated.

The 25% holdback on compensation payable under the HCV Late Claims Benefit Plan has now been removed following the 2019 Financial Sufficiency Orders of the Courts made in early 2021. Going forward, newly approved claimants will receive the full benefit payable to them at that time. Previously approved claimants who were affected by the holdback will now be paid the portion of their benefits that was withheld plus interest.
