HCV Late Claims Benefit Plan Appeals

Appealing the Late Claim Referee Decision on the Request for Late Claim

If your Late Claim Request is rejected, you may appeal the Late Claim Referee's decision by completing the Notice of Motion (PDF) form.

You must complete and return the Notice of Motion Form to the Court Monitor (Ms Luisa Ritacca, Stockwoods Barristers, TD North Tower, Suite 4130 - 77 King Street West, Toronto, Ontario M5K 1H1 or by email at hepcappeals@stockwoods.ca) within 30 days after receipt of the transmission letter of the Administrator's enclosing the Late Claim Referee's decision.

Your entire file and your completed form will be reviewed by the Court of the appropriate jurisdiction, which will decide your appeal. The Court decision is final.
