D E C I S I O N
This matter came before me on September 13, 2001.
The evidence in this case was that the claimant had not received
a blood transfusion during the class period.
The Claimant was the recipient of a transplant. To give Dr.
Ludwin, a physician who was in attendance at the hearing on
behalf of the Claimant, an opportunity to investigate whether
the person who provided the transplanted organ had received
blood during the class period, the matter was adjourned.
Dr. Ludwin informed me that there was no such evidence.
The Claimant also wrote saying that he had no additional
evidence to submit and that I should rule based on what I
had heard.
I result then, it is clear that there was no transfusion
given to the Claimant during the class period and unfortunately
his request for review must be rejected and the decision of
the Administrator upheld.
