D E C I S I O N

Claim ID number 4221

The undersigned has been designated to act as referee in a request for review submitted by the Claimant on September 19, 2001. The review was strictly limited to an analysis of the Claimant's file as provided, as both parties to the case advised that they had no further submission to make nor did they request a hearing. This review is about a claim for compensation submitted by the Claimant on January 20, 2000 which was rejected by the Administrator of the Hepatitis C Class Actions Settlement (the Administrator) on August 30 of the same year.

In this case, the Administrator agrees that the Claimant is HCV infected. However, the Claimant has not provided any reason to support her challenge and a review of her file confirms that she did not receive a blood transfusion during the Hepatitis C January 1 1986-July 1 1990 Class Actions Settlement period (Settlement Agreement). Such a confirmation is supported by the documents filled by the Claimant and the relevant sections of the forms filled by the attending physician .

Under such circumstances, it seems clear that the Claimant has not provided sufficient proof of her eligibility to the Compensation Program as provided in the Settlement Agreement pertaining to her case. This finding alone is sufficient to end the case.

For these reasons the request for review is rejected and the Administrator's decision is maintained.
